Agreement to Our Legal Terms
We are BORNOVA SAS. ("Company," "we," "us," "our"), a company registered in France at 1 Rue de Stockholm, 75008 Paris, France. Our VAT number is FR46921034088.
We operate the website https://www.bornovamedical.com (the "Site"), as well as any related products and services that link to these legal terms (the "Services").
You can contact us by phone at +33 7 58 89 36 63, by email at [email protected], or by mail at the address above.
These Legal Terms form a legally binding agreement between you (whether personally or on behalf of an entity) and BORNOVA SAS., concerning your access to and use of the Services. The Services are intended for users at least 13 years of age; minors under 18 must use the Services only with the permission and supervision of a parent or guardian.
1. Our Services
The information provided when using the Services is not intended for distribution to or use by any person or entity in any jurisdiction or country where such distribution or use would be contrary to law or regulation, or which would subject us to any registration requirement within that jurisdiction.
2. Intellectual Property Rights
We are the owner or licensee of all intellectual property rights in our Services — including all source code, databases, functionality, software, website designs, audio, video, text, photographs, and graphics (the "Content") — as well as the trademarks, service marks, and logos contained therein (the "Marks"). The Content and Marks are protected by French and international copyright and trademark law (notably Code de la propriété intellectuelle).
Subject to your compliance with these Legal Terms, we grant you a non-exclusive, non-transferable, revocable license to access the Services and download or print a copy of any portion of the Content to which you have properly gained access — solely for your personal, non-commercial use or internal business purpose.
3. User Representations
By using the Services, you represent and warrant that: (a) all registration information you submit is true, accurate, current, and complete; (b) you will maintain the accuracy of such information; (c) you have the legal capacity and agree to comply with these Legal Terms; (d) you are not a minor in your jurisdiction without parental permission; (e) you will not access the Services through automated or non-human means except as authorized; (f) you will not use the Services for any illegal or unauthorized purpose; and (g) your use of the Services will not violate any applicable law.
4. User Registration
You may be required to register to use certain Services. You agree to keep your password confidential and are responsible for all use of your account and password. We reserve the right to remove, reclaim, or change a username you select if we determine it is inappropriate, obscene, or otherwise objectionable.
5. Products
We make every effort to display as accurately as possible the colors, features, specifications, and details of the products available on the Services. However, we do not guarantee that the colors, features, specifications, and details will be accurate, complete, reliable, current, or free of other errors. All products are subject to availability.
6. Purchases and Payment
We accept the following payment methods:
- Visa
- Mastercard
- American Express
You agree to provide current, complete, and accurate purchase and account information for all purchases. All payments are settled in Euros (EUR).
Currency Conversion (Stripe Adaptive Pricing)
For visitors who select a non-EUR display currency (USD, GBP, PLN, CHF, and other supported currencies), Stripe Adaptive Pricing charges your card in the selected currency at Stripe's prevailing exchange rate. This rate typically includes a 2-4% FX margin already baked into the displayed amount. The merchant receives the equivalent in EUR. You assume all FX conversion costs charged by your card-issuing bank or by Stripe.
Refunds are issued in EUR — see our Refund Policy for details on how exchange-rate fluctuation may affect the amount you receive in your local currency.
We reserve the right to refuse any order placed through the Services. We may, in our sole discretion, limit or cancel quantities purchased per person, per household, or per order.
7. Returns & Refunds
Please review our Refund Policy before making any purchase. EU/EEA consumers also benefit from the 14-day right of withdrawal described in our Shipping Policy.

15. Privacy Policy
We care about data privacy and security. Please review our Privacy Policy and our Cookie Declaration. By using the Services, you agree to be bound by our Privacy Policy.
16. Copyright Infringements
We respect the intellectual property rights of others. If you believe that any material on the Services infringes a copyright you own or control, please notify us immediately at [email protected]. Please be aware that you may be liable for damages (including costs and attorneys' fees) if you make material misrepresentations.
17. Term and Termination
These Legal Terms remain in full force while you use the Services. We may, in our sole discretion and without notice or liability, deny access to and use of the Services to any person, including blocking certain IP addresses, for any reason or no reason — including breach of any representation, warranty, or covenant in these Legal Terms or applicable law.

22. Disclaimer
The information provided by BORNOVA SAS. on the Site is for general informational purposes only. All information on the Site is provided in good faith; however we make no representation or warranty of any kind, express or implied, regarding the accuracy, adequacy, validity, reliability, availability, or completeness of any information on the Site. Your use of the Site and your reliance on any information on the Site is solely at your own risk.
External Links Disclaimer
The Site may contain links to other websites or content belonging to or originating from third parties. Such external links are not investigated, monitored, or checked for accuracy, adequacy, validity, reliability, availability, or completeness by us. We will not be a party to or in any way be responsible for monitoring any transaction between you and third-party providers of products or services.
Testimonials Disclaimer
The Site may contain testimonials by users of our products or services. These reflect real-life experiences and opinions of those users; experiences are personal to those particular users and may not necessarily be representative of all users. We do not claim, and you should not assume, that all users will have the same experiences. Your individual results may vary.
The testimonials are submitted in various forms (text, audio, video) and are reviewed before posting. They appear verbatim except for grammar and typo corrections. The views and opinions belong solely to the individual user. The testimonials are not intended, nor should they be construed, as claims that our products or services can be used to diagnose, treat, mitigate, cure, prevent, or otherwise be used for any disease or medical condition. No testimonials have been clinically proven or evaluated.
23. Limitations of Liability
In no event will we or our directors, employees, or agents be liable to you or any third party for any direct, indirect, consequential, exemplary, incidental, special, or punitive damages, including lost profit, lost revenue, loss of data, or other damages arising from your use of the Services, even if we have been advised of the possibility of such damages.
24. Indemnification
You agree to defend, indemnify, and hold us harmless, including our subsidiaries, affiliates, and respective officers, agents, partners, and employees, from and against any loss, damage, liability, claim, or demand — including reasonable attorneys' fees and expenses — made by any third party due to or arising out of: (a) your Contributions; (b) use of the Services; (c) breach of these Legal Terms; (d) breach of representations and warranties; (e) violation of third-party rights including intellectual property; (f) overt harmful act toward any other user.

You agree we shall have no liability to you for any loss or corruption of any such data, and you hereby waive any right of action against us arising from any such loss or corruption.
26. Electronic Communications, Transactions, and Signatures

27. Miscellaneous
These Legal Terms and any policies or operating rules posted by us on the Services constitute the entire agreement between you and us. Our failure to exercise or enforce any right or provision of these Legal Terms shall not operate as a waiver. We may assign any or all of our rights and obligations to others at any time. We shall not be responsible or liable for any loss, damage, delay, or failure to act caused by any cause beyond our reasonable control.
If any provision or part of a provision of these Legal Terms is determined to be unlawful, void, or unenforceable, that provision or part is deemed severable and does not affect the validity and enforceability of the remaining provisions.
